1. Who we are
Tallowed Heifer LLC ("Tallowed Heifer," "we," "us," "our") is a small family business in Sanford, North Carolina. We handcraft grass-fed tallow skincare and home goods in small batches. Our store runs on Shopify at tallowedheifer.com. These Terms of Service ("Terms") apply whenever you visit our site or buy from us. By using the site or placing an order, you agree to these Terms. If you don't agree, please don't use the site.
2. Using our site
You must be at least 18 years old, or the age of majority where you live, to place an order. You may also use the site with a parent or guardian's involvement. Please don't use the site for anything unlawful. Don't try to interfere with how it works, don't upload anything harmful, and don't copy or scrape its content. We may refuse service, suspend access, or cancel orders if we believe these Terms are being broken.
3. Our products and descriptions
We do our best to describe and photograph our products accurately. Because everything is handmade in small batches from natural ingredients, color, scent, texture and size can vary a little from batch to batch and from the photos. These natural variations are part of what makes our products handmade. They are not defects.
Skincare disclaimer: Our products are cosmetics. They are not intended to diagnose, treat, cure, or prevent any disease, and nothing on our site is medical advice. Please read the full ingredient list before you buy. Patch test any new product on a small area of skin first. Stop using a product if irritation occurs. If you are pregnant or nursing, have a skin condition or allergies, or have any health concerns, please check with your doctor before use. For external use only. Keep out of reach of children and pets.
4. Pricing and errors
Prices are listed in U.S. dollars and may change at any time without notice. Occasionally a price, description, or availability may be listed in error. If that happens, we may correct it and cancel or update any affected order, even after you've received an order confirmation. If you've already been charged, we will refund you.
5. Orders, acceptance and cancellation
Your order is an offer to buy. We accept it when we ship it or have it ready for pickup. We may limit quantities, refuse an order, or cancel an order for any reason, including suspected fraud, stock problems, or pricing errors. If we cancel, we'll let you know and refund any amount charged. If you need to change or cancel your order, email us as soon as possible. Once an order has shipped, we can't change it.
6. Payment
We accept the payment methods shown at checkout, processed securely by Shopify and its payment partners. We never see or store your full card number. By paying, you confirm you're authorized to use that payment method. Applicable sales tax is calculated at checkout.
7. Shipping
We currently ship within the United States only. Rates, delivery times and pickup options are described in our Shipping Policy, which is part of these Terms. Risk of loss passes to you when the carrier delivers your package, or when you pick up your order.
8. Returns and refunds
Our Refund Policy is part of these Terms. In short: because these are personal care products, we can't accept returns or give refunds on skincare and personal care items once an order has shipped. If something arrives damaged or defective, or you receive the wrong item, contact us right away with your order number and a photo, and we'll make it right.
9. Gift cards
Tallowed Heifer gift cards are delivered by email and never expire. An unused gift card can be refunded to the original payment method. Once a gift card has been partly or fully used, it is non-refundable. Gift cards can't be redeemed for cash except where the law requires it. Please treat a gift card like cash. We can't replace a lost or stolen code unless the law requires it.
10. Discount codes and promotions
Unless we say otherwise, only one discount code can be used per order. Codes have no cash value, can't be exchanged for cash, and can't be applied to past orders. We may change, limit, or end any promotion or code at any time. We may also cancel orders that misuse a code.
11. Reviews and other content you share
We love hearing from you. When you post a review, photo, comment or other content, you confirm it's honest, it's yours to share, and it doesn't break any law or anyone's rights. You also give us a non-exclusive, royalty-free, perpetual license to use, display, and share that content in connection with our business, including on our site and social media. We may remove content at our discretion. Please don't post medical claims about our products.
12. Intellectual property
Everything on this site belongs to Tallowed Heifer LLC or its licensors and is protected by law. That includes our name, logo, photos, product names, text and design. Please don't copy or use it without our written permission.
13. Third-party services
Our site uses services from others, such as Shopify, payment processors, shipping carriers, and review or email apps. Their own terms and privacy policies apply to how they handle your information. We aren't responsible for third-party websites we link to.
14. Limitation of liability
We work hard to keep the site running smoothly and our products wonderful. However, the site and our products are provided "as is" and "as available," to the fullest extent the law allows. Tallowed Heifer LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of the site or our products. Our total liability for any claim is limited to the amount you paid for the product involved. Some states don't allow certain limitations, so some of these may not apply to you.
15. Indemnity
You agree to defend and hold harmless Tallowed Heifer LLC and its owners and team from any claims, losses, or expenses (including reasonable attorneys' fees) that come from your breach of these Terms or your misuse of the site or our products.
16. Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in North Carolina. We always prefer to sort things out together first, so please reach out to us.
17. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above shows when. Changes apply from the time they're posted. Orders placed before a change follow the Terms that were in place when you ordered.
